Crímenes contra la humanidad de género

Como una especie de prefacio a lo que sigue, copio y pego esto de la Amnistía Internacional sobre los derechos de la mujer -- "los derechos de las mujeres son los derechos humanos."

Women's rights are human rights. This notion is at once fundamental and revolutionary. In theory, women have never been overtly excluded from the concept of human rights. In 1945, the UN Charter afforded to women and men equal economic, social, cultural, political and civil rights. Nevertheless, because women traditionally have been relegated to the private sphere and to subordinate status in society, they have generally been excluded from recognized definitions and interpretations of human rights. As such, women and girls' experiences with human rights abuse have been virtually ignored (UNIFEM, 1999). Most of the casualties of war are women and children; most of the world's refugees and displaced people are women and children; most of the world's poor are women and children. Still, because of persistent discrimination against women and women's virtual invisibility, these human rights violations continue with no clear sign of abatement.

El profesor de derecho penal, autor y activista Miguel Ángel Rodríguez Arias ha enviado lo siguiente, y me he tomado la libertad de traducir parte del documento al inglés (en rojo, entre paréntesis). DECLARACIÓN DE LA ASSOCIACIÓ CATALANA DE JURISTES DEMÒCRATES CONTRA LA IMPUNIDAD DE LOS CRIMENES DE LESA HUMANIDAD DE GÉNERO COMETIDOS POR EL FRANQUISMO (Declaration of the Catalan Association of Democratic Jurists Against the Impunity of Gender-Based Crimes Against Humanity Under Francoism):

Con motivo de las jornadas “Las Mujeres en la Guerra Civil y en la Dictadura franquista” celebradas en Barcelona los días 13 y 14 de noviembre de 2009, reunidas más de 20 personas expertas de diferentes ámbitos disciplinares, testimonios, represaliadas y con más de 200 asistentes se han examinado las cuestiones relativas al papel de las mujeres de las zonas rebeldes en contraposición a las de zonas republicanas; las mujeres represaliadas por haber sido la 1ª generación de mujeres en ejercer sus derechos y libertades, las mujeres víctimas de los olvidados crímenes de lesa humanidad de género; la mujer luchadora en la movilización política, sindical, antirepresiva; la mujer en la lucha armada y en el frente de guerra; la mujer durante la transición; la mujer como protagonista y única autora de su propia Memoria Histórica y la mujer delante de la falta de actos de reparación y justicia contra el olvido y la impunidad de los culpables. (The document below comes out of the sessions on "Women in the Spanish Civil War and Franco Dictatorship," held in Barcelona on November 13-14, 2009, which brought together more than 20 experts in different disciplinary fields; testimonies; female victims of the regime; and more than 200 attendees. Examined were questions regarding the role of women in the rebel zones, in contrast with those in republican areas; women victimized for being part of the 1st generation of women to exert their rights and freedoms; female victims of the forgotten gender-based crimes against humanity; the female fighter in the political, sindacalist, antirepressive movement; women in the armed struggle and on the battlefront; women during the transition; women as protagonists and the only authors of their own Historical Memory; and women facing the lack of reparation and justice against forgetting and the impunity of the guilty.)

En base a todo esto formulamos las siguientes conclusiones: (Based on all of the above we formulate the following conclusions)

1- Exigimos “Verdad, Justicia y Reparación” para todas las víctimas del genocidio franquista en todas sus formas. (We demand "Truth, Justice and Reparation" for all victims of the Francoist genocide in all its forms)

2- Denunciamos, en particular, el completo olvido dentro de la ley de la Memoria Histórica de los crímenes de lesa humanidad contra las mujeres republicanas y que son: (In particular, we denounce the Law of Historical Memory's utter erasure of crimes against humanity against republican women, which are as follows:)

2.1) Vulneración flagrante de la Convención de la Haya de 1898 y de Ginebra de 1929 contra las mujeres combatientes por la II República. (The flagrant violation of the 1898 Hague and 1929 Geneva Convention against women fighting for the II Republic)

2.2) Detenciones ilegales masivas y sin cargos de mujeres sistemáticamente como represalia por su defensa del régimen democrático republicano o por su simple lazo de parentesco. (Illegal, unfounded and systematic mass detentions of women for their defense of the republican democratic regime or for their simple familial ties).

2.3) Tortura y trato degradante a las mujeres dentro de las comisarías, prisiones y centros de detención ilegal del franquismo. (Torture and degrading treatment of women in commisaries, prisons and illegal detention centers under Francoism)

2.4) Violaciones y abusos sexuales a las presas y detenidas. (Rape and sexual abuse of females detainees and prisoners).

2.5) Vulneración de las condiciones higiénicas, alimentarias y sanitarias reconocidas en los Convenios Internacionales, en particular respecto a las madres lactantes presas y sus bebés, amontonados, durmiendo en el suelo y muchos de ellos dejados morir de hambre y enfermedad. (Violation of hygienic, nutritional and health conditions recognized in the International Conventions; in particular, with respect to jailed nursing mothers and their babies, piled up and sleeping on the floor, many of them left to die of hunger and disease).

2.6) Crímen de Persecución, depuración de los cargos publicos y de ejercer profesiones liberales, así como privadas de ejercer cualquier trabajo. En consecuencia, estigmatizadas y condenadas a la marginación social. (the Crime of Persecution, removal from public positions and prohibition from exerting liberal professions, or performing any job. As a result, women were stigmatized and condemned to social marginalization.)

2.7) Desaparición forzada de menores sustraídos de los brazos de sus madres presas, para ser entregados a familias adeptas a la dictadura. Éste continúa siendo el mayor caso vigente actualmente, a nivel europeo, de vulneración de los Derecho Fundamentales de las mujeres en la esfera de la maternidad y de desaparición infantil, expresamente contrario al Convenio Europeo de los Derechos Humanos y la Convención Internacional para la eliminación de todas las formas de discriminación contra la Mujer. (Forced disappearance of minors, torn from the arms of their imprisoned mothers, to later be delivered to families allied with the dictatorship. This continues to be the most striking example at present, on a European scale, of the violation of the Fundamental Rights of Women in the realm of maternity and child disappearance; it is expressly in opposition to the European Convention of Human Rights and the International Convention for the elimination of all forms of discrimination against Woman.)

3- Reclamamos al Gobierno español la apertura de una “investigación oficial efectiva e independiente” de todos sus crímenes, tal y como exige el Tribunal Europeo de Derechos Humanos, que conduzca al esclarecimiento de los hechos y el enjuiciamiento penal de sus responsables. (We petition the Government of Spain to open an "official, effective and independent investigation" of all its crimes -- as demands the European Tribunal of Human Rights - to lead to an understanding of the facts and to judgment, in the courts, of those responsable).
